Terms of Service

These terms apply to your use of trulyautomation.com and to payments you make to Truly Automation LLC ("Truly Automation," "we," "us"). By using the site or paying us, you agree to these terms. If you don't agree, please don't use the site.

This site describes the marketing services we offer. The exact services, prices and terms for each client are set out in a separate written Marketing Services Agreement signed by both sides. If that agreement and these terms ever conflict, the signed agreement controls.

Prices and package details on this site can change at any time. Nothing on the site is an offer until we both sign an agreement.

Our free marketing checkup is general information about your online presence, based on what we can see publicly. There is no cost and no obligation to buy anything. It is not legal, financial or tax advice.

We work hard for every client, but search rankings, ad performance, reviews, calls and sales depend on many things we don't control, including search engines, ad platforms, competition and how leads are handled. We do not guarantee any particular ranking, number of leads or amount of revenue.

• Payments are processed by Stripe. By paying, you also agree to Stripe's terms.
• When you sign up for a monthly plan, you authorize us to charge your card or bank account (ACH) automatically each month on your billing date until the plan is canceled under your agreement.
• If you pay by bank account, you authorize the debit and agree that a payment returned by your bank may be charged again.
• Setup fees and cancellation terms are set out in your Marketing Services Agreement.
• Advertising spend is paid by you directly to the ad platforms and is not part of our fees unless your agreement says otherwise.

Truly Automation LLC sends text messages only to people who opt in. Our free checkup form has two separate, optional checkboxes, and neither is ever pre-checked:

• Checkup texts: messages about your checkup request, such as your report link and appointment reminders. Message frequency varies.
• Marketing texts: messages about our marketing services, special offers and updates. Up to 4 messages per month. We only send marketing texts if you check the marketing box.

You can choose either, both or neither. Agreeing to texts is not a condition of any purchase and is not required to get a checkup.

• You must be 18 or older to opt in to text messages.
• Message and data rates may apply.
• Reply STOP at any time to opt out, and you will get one message confirming you have been unsubscribed. Reply HELP for help.

• Carriers are not liable for delayed or undelivered messages.
• Separately, we operate missed-call text-back and AI receptionist messaging on our clients' business phone lines. Those messages only reply to people who contacted that business first.

The AI receptionist demo on our site uses made-up businesses, prices and appointment times. Its replies are generated by AI, may be inaccurate, and are only meant to show how the service works. Please don't enter personal or sensitive information.

Please don't misuse the site. That includes trying to break into or overload it, scraping it, submitting false or harmful information through our forms, or using the demo to produce unlawful content.

The text, designs, graphics and code on this site belong to Truly Automation or the people who licensed them to us. Client names and screenshots are shown with permission and belong to those businesses. Please don't copy our content without asking.

Our site links to other websites, such as our clients' sites. We are not responsible for the content or practices of those sites.

The site is provided "as is." To the extent the law allows, we make no warranties about the site, including that it will always be available or error-free.

To the extent the law allows, Truly Automation is not liable for indirect, incidental or consequential damages, including lost profits, arising from your use of this site. For use of the site itself, our total liability will not exceed $100. Liability for paid services is governed by your Marketing Services Agreement.

These terms are governed by the laws of the State of North Carolina. Any dispute will be handled in the state or federal courts located in North Carolina, unless your signed agreement says otherwise.

We may update these terms from time to time. When we do, we will change the date at the top of this page. Using the site after a change means you accept the updated terms.
